This special issue of the APBREBES updates publishes the first APBREBES Working Paper. It addresses the industry-led move by UPOV to introduce DNA fingerprints in variety descriptions and collections of reference varieties held by public offices in UPOV member states. These changes, going beyond the UPOV Conventions, will support variety protection rights title holders to identify protected plant material and, among others, claim royalty incomes from agricultural products from Least Developed Countries in spite of a transitional period granted by the WTO.

According to the UPOV Conventions, it is up to member states to provide for appropriate legal remedies for the effective enforcement of the Conventions. But UPOV member states are being expected to play a crucial role in providing expensive technical and administrative infrastructure, as well as legally questionable confidentiality arrangements, in order to enable already powerful seed companies to enforce royalty income on the basis of evidence from DNA fingerprints of suspected seeds or plant material.
